SRL ”Anintercom”  a întreprins un nou pas în vederea lansării stației de sortare a deșeurilor. Astfel, în data de 14 august curent, am depus o cerere de chemare în judecată contra firmei cu care, în august 2022 am încheiat contractul de livrare a utilajului de sortare, firmă care, din motive neclare, nu și-a onorat obligațiunile. Menționăm că noi am transferat, conform contractului, ca plată prealabilă suma de 70 mii de euro (la acea dată echivalent a 1370603 lei) în beneficiul Vânzătorului, însă până în prezent domniile lor nu au livrat marfa (utilajul de sortare) și nu au restituit suma plății prealabile. Menționăm că noi nu am semnat vreo factură de recepționare a respectivului utilaj, deoarece marfa nu a fost livrată. Așa cum am menționat mai sus, am efectuat doar plata prealabilă.

Vom adăuga că de câteva ori am propus Vânzătorului (atât verbal, cât și scris) să vină cu explicații privind nelivrarea mărfii sau să vină cu propuneri privind ajustarea contractului, cu propuneri de modificare a unor prevederi care ar fi contribuit la buna executare a contractului, însă nu am sesizat vreo inițiativă din partea domniilor lor.

Respectiv, deoarece avem și noi niște termene de respectat conform proiectului pe care îl implementăm, am decis să încasăm suma transferată ca plată prealabilă pe cale judiciară (desigur, preliminar, în martie și iunie, am adresat Vânzătorului 2 somații legale priun care i-am oferit posibilitatea să restituie amiabil suma primită de la noi).

În prezent cauza civilă este în proces de judecare. Ne reprezintă una din firmele de avocatură dintre cele mai prestigioase și reputate din Republica Moldova.  Suntem siguri că vom reuși să ne încadrăm în termen cu încasarea sumei și achiziționarea (la fel ca și în 2022 prin procedură de achiziție cu publciare) a unor utilaje de sortare a deșeurilor care vor permite lansarea cât de curând a stației noastre de sortare, pe care noi și abonații noștri o așteptăm de atâta timp.

A new step towards the launch of the waste sorting station
LLC „Anintercom” took a new step towards the launch of the waste sorting station. Thus, on August 14, this year, we have filed a lawsuit against the company with which, in August 2022, we concluded the contract for the delivery of the sorting equipment, a company which, for unclear reasons, has not honored its obligations. We mention that we have transferred, according to the contract, as a prepayment the amount of 70 thousand euros (at that time equivalent to 1370603 lei) to the benefit of the Seller, but to date they have not delivered the goods (the sorting equipment) and have not returned the amount of the prepayment. It should be noted that we have not signed any invoice for the acceptance of the sorting equipment, as the goods have not been delivered. As mentioned above, we only made the pre-payment.

We will add that on several occasions we proposed to the Seller (both verbally and in writing) to come up with explanations regarding the non-delivery of the goods or to come up with proposals for the adjustment of the contract, with proposals for the amendment of some provisions that would have contributed to the proper performance of the contract, but we did not notice any initiative from their side.

Respectively, since we also have some deadlines to meet according to the project we are implementing, we decided to collect the transferred amount as a pre-payment through the court (of course, preliminarily, in March and June, we sent the Seller 2 legal summonses in which we offered him the possibility to amicably return the amount received from us).

The civil case is currently in the process of trial. We are represented by one of the most prestigious and reputable law firms in the Republic of Moldova. We are confident that we will be able to meet the deadline with the collection of the amount and the purchase (as in 2022 through a public procurement procedure) of waste sorting equipment that will allow us to launch our sorting station, which we and our subscribers have been waiting for so long, as soon as possible.

În data de 16 august 2024 cererea de chemare în judecată depusă de SRL ”Anintercom” a fost acceptată spre examinare, iar pe conturile și pe patrimoniul firmei debitoare a fost aplicat sechestru în vederea asigurării acțiunii judecătorești. Atasăm mai jos extrasele confirmative din încheierile judecătorești respective.

On August 16, 2024, the claim filed by LLC „Anintercom” was accepted for examination, and the accounts and assets of the debtor company were seized for the purpose of securing the court action. We enclose below the confirmatory extracts from the respective judgments.
